Comelec Removes Roadblock to Raffy Tulfo's Senate Candidacy

The Commission on Election's second division has dismissed the petition seeking to block the senatorial bid of broadcaster Raffy Tulfo from a woman who claimed to be his legal wife.

In a resolution promulgated Dec. 16, 2021, released to media only on Thursday, the second division denied the petition to cancel Tulfo's certificate of candidacy filed by a certain Julieta Licup Pearson, who claims to be the broadcaster's wife, for lack of merit.

Pearson alleged that Tulfo made false material misrepresentation in his COC when he indicated ACT-CIS partylist Rep. Jocelyn Tulfo as his wife. Pearson also claimed Tulfo misrepresented his period of residence in the Philippines, and that he is a dual citizen.

In denying the petition, the second division said that Tulfo's alleged misrepresentation on the name of his legal spouse is "not material" so as to warrant the cancellation of his COC because it does not pertain to his qualification for elective office.

Pearson also failed to substantiate her claims that Tulfo lived in the United Status and married an American citizen, the division said. Even if Tulfo's period of residence is below 62 years and two months, all he needed was to be a resident of the Philippines for not less than two years immediately preceding election day, it added.

As to the claim that Tulfo was a dual citizen and must be disqualified to run for senator, the division said Pearson cited the wrong provision. She quoted Section 40 of the Local Government Code, which does not apply to senatorial aspirants as it is not a local position.

Tulfo, host of the popular "Idol in Action" TV show, hopes to translate his popularity as the Filipino masses' court of last resort into a seat in the legislature. He led the list of preferred senatorial candidates in the January 2022 Pulse Asia survey.
