Gov't Workers to Get Night Shift Differential Pay Under New Law

President Rodrigo Duterte has signed into law a measure granting government workers a night differential pay.

Under Republic Act No. 11701, signed on April 13 but made public only on Monday, government employees with ranks from division chief and below or their equivalent are eligible for night differential pay.

The night shift differential rate according to the new law shall be set at a maximum of 20% of the hourly basic rate of the employee, as determined by the head of the agency, for each hour of work performed between 6 p.m. to 6 a.m.

The policy covers government workers employed on a permanent, contractual, temporary, or casual basis. Employees of government-owned and -controlled corporations are also covered by the policy.

However, for government workers whose office hours fall between 6 a.m. to 6 p.m., any work rendered beyond the said period will be paid overtime in accordance with existing policies.

Exempted from the night differential pay law are government employees whose services are on call, 24 hours a day such as uniformed personnel. These include the military, police, firefighters, and jail wardens.
